AN ACT RELATING TO COURTS AND CIVIL PROCEDURE - PROCEDURE IN PARTICULAR ACTIONS

Provides that those seeking review of a post-conviction relief final judgment must file their petition for writ of certiorari within sixty days from the date of final judgment.

  • SECTION 1. Section 10-9.1-9 of the General Laws in Chapter 10-9.1 entitled "Post Conviction Remedy" is hereby amended to read as follows:
  • 10-9.1-9. Appeal.
  • An aggrieved party may seek seeking review of a final judgment entered in a proceeding brought under this chapter shall do so by filing a petition for writ of certiorari in accordance with the supreme court rules of appellate procedure within sixty (60) days of the entry of the final judgment.
