  • It is enacted by the General Assembly as follows:
  • SECTION 1. Chapter 27-8 of the General Laws entitled "Casualty Insurance Generally" is hereby amended by adding thereto the following section:
  • 27-8-1.1. Vacant property.
  • (a) No residential property shall be declared vacant under any policy of insurance after a period of thirty (30) days or less; provided that the owner of the residential property is in the process of renovation and/or rehabilitation of the premises pursuant to the issuance of the appropriate building permits by the municipality wherein the property is located.
  • (b) The process of renovation and/or rehabilitation shall commence upon the date when the application for the issuance of a building permit is filed and shall cease upon the date when the renovation and/or rehabilitation is completed and a certificate of occupancy has been obtained.
  • SECTION 2. This act shall take effect upon passage.

  • This act would exempt residential property from the definition of vacant property provided the owner of the property is in the process of renovation and/or rehabilitation pursuant to building permits issued by the local municipality from the date of application for the permits to the date of completion of the renovation and/or rehabilitation and the issuance of a certificate of occupancy.

  • No residential property insurance policy shall exclude coverage for vandalism or malicious mischief unless the dwelling has been vacant for more than sixty (60) consecutive days immediately before the loss.
