AN ACT RELATING TO MOTOR AND OTHER VEHICLES -- DEALERSHIPS

Requires motor vehicle dealers to disclose in writing that a vehicle being sold has a spare tire/ jack or is otherwise equipped in compliance with applicable law. There shall be a civil penalty of $100 for a violation under this subsection.

  • It is enacted by the General Assembly as follows:
  • SECTION 1. Chapter 31-5.1 of the General Laws entitled "Regulation of Business Practices Among Motor Vehicle Manufacturers, Distributors, and Dealers" is hereby amended by adding thereto the following section:
  • 31-5.1-22. Spare tire modification.
  • (a) Motor vehicle dealerships licensed to make sales in this state shall, as an adjunct to a motor vehicle sale, disclose by a signed statement whether or not the vehicle is equipped with a spare tire, which can be either a full-sized spare of the same configuration as the road wheels or a "compact spare," so called.
  • (b) Failure to provide the signed disclosure shall be a misdemeanor, and upon conviction the license holder shall be fined in an amount not to exceed one hundred dollars ($100).
  • SECTION 2. This act shall take effect upon passage.
  • It is enacted by the GeneralAssembly as follows:
  • SECTION 1. Section 31-4-11 of the General Laws in Chapter 31-4 entitled "Transfer of Vehicles" is hereby amended to read as follows:
  • 31-4-11. Sale of automobiles – Required equipment.
  • (a) No automobile shall be sold, whether new or used, by a dealer, at wholesale or retail, unless the automobile is equipped with a spare tire and a jack, both of which must be functional and operational. The provisions of this section shall not apply:
  • (1) To an automobile equipped with tires that without any tire air inflation permit vehicle operation for at least fifty (50) miles at speeds up to at least fifty-five (55) miles per hour; or
  • (2) An automobile equipped with a factory installed tire repair and inflation system.
  • (b) A violation of this section (a) shallconstitute a misdemeanor.
  • (c) For each sale of a new or used vehicle by a dealer, the dealer shallprovide a written disclosure that the vehicle actually has a spare tire and jack or the vehicle is equipped with one of the exceptions to a spare tire and jack as provided in this section. There shallbe a civilpenalty of one hundred dollars ($100) for a violation under this subsection.
  • SECTION 2. This act shalltake effect upon passage.
